FBMJ attorneys, Anthony D. Pignotti and David C. McMurtrie, recently obtained a verdict in favor of their client in a Federal Civil Rights jury trial in the United States District Court for the Western District of Michigan in Marquette, MI.  The plaintiff in that case was a prisoner incarcerated in the custody of the Michigan Department of Corrections at the Alger Correctional Facility in Munising, MI at the time of the alleged incidents at issue. The plaintiff filed a complaint pursuant to 42 U.S.C § 1983 and alleged that the defendant, a medical doctor who worked in the prison health care unit, violated his Eighth Amendment right to be free from cruel and unusual punishment. The plaintiff alleged that the defendant’s deliberate indifference to his serious medical needs resulted in the need for a left orchiectomy. After litigating the case for more than four years, the case finally went to a jury trial. Mr. Pignotti and Mr. McMurtrie were able to successfully obtain a verdict from a Federal Jury in favor of their client.
