Joseph McGill Publishes Article: Medicare Set-Asides – Response to “Emergency Bulletin”
FBM attorney Joseph McGill has recently authored an article titled Medicare Set-Asides – Response to “Emergency Bulletin”, published in the Michigan Defense Quarterly, (Volume 26, No. 3 January, 2010). The article is in response to an “Emergency Bulletin” issued in the name of the Negligence Law Section of the State Bar of Michigan, and challenges the assumption that recent changes to the Medicare, Medicaid and SCHIP Extension Act of 2007 (MMSEA) allow business as usual. Mr. McGill points out in his article that the recent changes to the MMSEA are evidence of a vastly more comprehensive data gathering scheme by the federal government that will be used to determine when Medicare is appropriately a secondary payer. He submits that’s all attorneys resolving injury claims should pay close attention to these changes as virtually all liability settlements address both past and future medicals as an essential component of the resolved dispute, and will involve Medicare or Medicaid.
