FBMJ’s Randall Juip Leads Trial Team Success in Class Action Lawsuit
Foley, Baron, Metzger & Juip Partners Randall Juip and Kim Sveska were successful in obtaining a no cause of action verdict in a recent class action lawsuit in northern Michigan. The 170 claimants in the case were the first class-action suit tried in the U.S. to target a medical practice for exposing patients to contaminated steroid injections manufactured by Massachusetts-based New England Compounding Center after an outbreak of fungal meningitis three years earlier. After a nine-day trial, the jury returned a verdict of no cause of action against all defendants after deliberating for just over 2 ½ hours.
